Darshan Driving School Pty Ltd (DDS)
ABN: 13 649 118 472
Effective date: 16 October 2026

1. Scope

This policy explains how DDS handles personal information when you enquire, book or receive services, use our websites, app or portals, or communicate with our staff and instructors. It also covers relevant information from parents, authorised representatives and funding organisations.

Our Terms and Conditions and Cancellation, Rescheduling and Gift Voucher Policy explain the commercial rules. This Privacy Policy does not change those rules or create a separate refund entitlement.

2. Information we collect

Depending on your interaction and service, information may include:

  • Name, contact details, pickup address and relevant age or date-of-birth information.
  • Licence or learner-permit details and documents reasonably required for eligibility checks.
  • Bookings, attendance, lesson progress, assessments, test outcomes and relevant instructor notes.
  • Payment status, transaction references, invoices, packages, gift-voucher balances and cancellation records.
  • Messages, enquiries, complaints, feedback and your communication preferences.
  • Relevant health, disability, accessibility or support information needed for safe or funded services, including NDIS or TAC arrangements where applicable.
  • Details of authorised contacts, representatives, plan managers and funding organisations.
  • Website and app usage information, such as IP address, device information, cookies and technical logs.

We collect sensitive information only with the consent required by law or another lawful basis. We seek only information reasonably necessary for the relevant purpose. Payment providers may collect card details directly under their own privacy terms; do not send card security details through ordinary email or messages.

3. How we collect information

We collect information directly through booking forms, customer accounts, documents, phone conversations, email, SMS, supported messaging channels and lessons. We may also receive relevant information from your instructor, an authorised representative, a referring organisation or funding body where consent or law permits.

If you provide another person’s information, ensure you have authority and make this policy available to them. A person paying for a lesson is not automatically authorised to receive all information about the learner.

You may make a general enquiry without identifying yourself where practicable. We may need identifying information to confirm eligibility, provide a booking or process funded services. We will explain if missing information prevents us providing a requested service.

4. How we use information

We use relevant information to arrange and deliver services; allocate instructors; check eligibility; support safe learning; administer accounts and payments; manage cancellations, vouchers and legally required refunds; communicate about bookings; address complaints; meet funding, recordkeeping and legal obligations; and maintain our systems.

We may use de-identified or aggregated information for service improvement. Any use of identifiable information for another purpose must have an appropriate lawful basis.

5. Who may receive information

We share information only where reasonably needed and permitted, including with:

  • Assigned instructors and authorised DDS personnel involved in your service.
  • Providers supporting bookings, accounting, payments, hosting, communications, document signing and technical operations, including Laabam where used.
  • Parents, guardians or other representatives where you authorise disclosure or they have appropriate legal authority.
  • NDIS or TAC agencies, plan managers, support coordinators and referral partners where relevant and authorised or required.
  • Insurers, professional advisers, regulators, emergency services or other recipients where disclosure is lawfully required or permitted.

We limit access to the information needed for the relevant task. Instructor access to your booking information does not itself authorise unrelated marketing or disclosure.

6. Overseas service providers

Some technology, communications or support providers may process, store or access information outside Australia. Where overseas disclosure occurs, DDS will take the steps required by applicable privacy law to protect the information.

7. Marketing preferences

We send marketing communications only with consent or another basis permitted by applicable law. Providing booking details, being added to our database or accepting our terms does not automatically amount to consent for every marketing use.

Marketing email and electronic messages include a working unsubscribe method. You can also request removal from marketing by contacting us. We action unsubscribe requests within five working days, or sooner where required. We do not require you to log in or pay a fee to unsubscribe.

Unsubscribing from marketing does not stop necessary service messages, such as confirmations, booking changes, safety notices, invoices or responses to your requests. Those messages are kept separate from promotional content.

8. Cookies and advertising

Our websites may use cookies and similar tools for functionality, usage measurement and advertising. Where enabled, services such as Google Analytics or advertising platforms may receive device, browsing and interaction information under their own privacy terms.

You can manage cookies through browser settings and advertising preferences through the relevant platform. Blocking some cookies may affect site functions. We obtain consent where required and do not assume that disability, health or funded-service records are available for advertising use.

9. Photos, videos, testimonials and recordings

We seek separate, informed permission before using identifiable photos, videos or testimonials for promotion. Refusing promotional permission does not prevent access to ordinary services. You may withdraw permission for future promotional use by contacting DDS; we will explain any practical limits affecting material already distributed.

If recordings or images are collected for training, incident documentation or service records, DDS will explain the purpose and obtain any legally required consent. This policy alone is not blanket permission to record you. Sharing a lesson report or media with a parent or another contact requires appropriate authority.

10. Security and retention

DDS takes reasonable steps to protect information from misuse, loss and unauthorised access, modification or disclosure. We restrict access according to role and work with providers to maintain appropriate safeguards. No system can guarantee complete security; this does not remove our legal obligations.

We retain information for as long as reasonably needed for the purposes for which it was collected and applicable legal, accounting, insurance, funding and dispute requirements. When it is no longer required, we take reasonable steps to securely destroy or de-identify it, subject to lawful retention obligations.

11. Access, correction and privacy complaints

Contact DDS to request access to or correction of your personal information, or to raise a privacy concern. We may verify your identity and authority before releasing information. Access may be limited where law permits; we will explain a refusal and available complaint options where required.

We aim to respond to privacy enquiries and complaints within 30 days. If more time is reasonably needed, we will explain the delay. If you remain dissatisfied, you may contact the Office of the Australian Information Commissioner at oaic.gov.au or another privacy authority with jurisdiction, including the Victorian Health Complaints Commissioner for relevant health-information matters.

12. Changes and contact

We may update this policy to reflect changes in our practices or applicable law. The effective date is shown above. We will take appropriate steps to notify you of material changes and obtain additional consent where required. Publication of an update does not itself authorise a new use of sensitive information or override existing legal rights.
